Agreement

These Terms of Service are between you and Your Epic Battle LLC. By creating an account, uploading content, buying or using virtual items, generating a battle video, sharing content, or otherwise using the Service, you agree to these Terms.

If you do not agree, do not use the Service. Additional posted terms, checkout terms, product rules, or official rules may apply to specific features and become part of these Terms when presented to you.

Eligibility

The Service is for users 18 or older. Do not create an account, use the Service, upload content, submit images, or participate in public features if you are under 18.

Do not upload images, video, names, likenesses, voices, personal information, or other content of anyone under 18. You may not use the Service if applicable law bars you from doing so, if we previously suspended or terminated you for misconduct, or if you are using the Service for another person without authority.

Accounts and security

You are responsible for your account credentials and for all activity under your account. Provide accurate information and keep it current.

Notify us promptly at [email protected] if you believe your account has been compromised. We may require verification, limit account features, suspend access, or terminate accounts when necessary to protect users, the Service, or our business.

The Service

Your Epic Battle is an entertainment platform that lets users submit content, including photos, face images, names, prompts, battle choices, and other materials, to create fictional AI/cinematic battle videos and related content.

Generated outputs are fictional entertainment. They are not factual recordings, endorsements, real events, documentary depictions, or proof that any person said or did anything shown in an output.

We may modify, suspend, discontinue, restrict, rebalance, or remove any part of the Service at any time, including features, virtual items, token systems, Fame, keys, chests, loadouts, leaderboards, prices, availability, moderation systems, or content policies.

User content and permissions

User Content means anything you submit, upload, create, post, share, transmit, or make available through the Service, including photos, face images, names, likenesses, usernames, prompts, text, video, audio, battle configurations, profile content, comments, reports, and generated outputs you publish or share.

You retain rights you own in your User Content. You are responsible for having all rights, permissions, and consents needed to submit it and allow us and our service providers to use it as described in these Terms.

Before uploading another adult's face, likeness, name, voice, persona, or personal information, you must have that person's permission. You may not upload any minor's image, likeness, voice, name, or personal information.

• Your User Content must not violate copyright, trademark, privacy, publicity, likeness, biometric, contractual, or other rights.
• Your User Content must not contain non-consensual intimate imagery, sexual content involving minors, exploitative content, deceptive impersonation, harassment, threats, defamation, doxxing, malware, spam, or illegal content.
• You may not create or share outputs that falsely imply real events, real endorsements, criminal conduct, sexual content, actual statements by a depicted person, or other deception likely to harm someone.

License to user content

You grant Your Epic Battle LLC a worldwide, non-exclusive, royalty-free, fully paid, transferable, sublicensable license to host, store, reproduce, modify, adapt, transform, create derivative works from, generate outputs from, publish, display, perform, distribute, transmit, promote, moderate, remove, and otherwise use your User Content to operate, provide, improve, secure, moderate, market, and develop the Service.

This license includes the right to process uploaded face images, photos, likenesses, names, personas, prompts, and other submitted materials to create AI/cinematic battle videos and related outputs.

For User Content you make public, share, publish, submit to leaderboards, or otherwise make available to other users, the license also lets us display, promote, redistribute, and make that content available through the Service and related marketing channels.

This license continues as long as needed to provide the Service, operate shared or public features, preserve generated outputs, comply with law, resolve disputes, enforce agreements, maintain security, and keep backup or archival copies.

AI outputs

AI-generated outputs may be unpredictable, inaccurate, incomplete, offensive, similar to outputs generated for other users, or inconsistent with your expectations. We do not guarantee that any output will be unique, error-free, suitable for a particular purpose, legally usable by you, or free from third-party claims.

Subject to your compliance with these Terms, you may use outputs generated for you for personal, non-commercial sharing unless the Service states otherwise. Commercial use requires our prior written permission unless expressly enabled by a paid plan or written policy.

We retain all rights in the Service, platform, software, templates, cinematic systems, prompts, model configurations, visual effects, branding, and other materials we provide.

Public sharing and leaderboards

The Service may allow you to publish, share, rank, like, remix, or otherwise interact with content publicly. Public submissions, usernames, profile details, outputs, leaderboard entries, rankings, and shared battle content may be viewed, copied, screenshotted, downloaded, indexed, discussed, embedded, or reshared by others.

Do not share content publicly unless you have the right to do so and are comfortable with others seeing it. Deleting content from the Service may not remove copies saved, cached, downloaded, indexed, or reshared by others outside our control.

Leaderboards, Fame rankings, battle rankings, and similar systems are for entertainment only. We may adjust, reset, remove, audit, or modify rankings, Fame, rewards, or visibility at any time, including to address cheating, abuse, errors, safety concerns, or system changes.

Virtual items and no prizes

The Service may include virtual tokens, Fame, keys, chests, loadout items, cosmetics, boosts, rewards, or other virtual items. Virtual items are a limited, revocable license to access digital features within the Service.

Virtual items have no cash value, are not legal tender, are not property, create no property interest, and may not be sold, transferred, exchanged, redeemed, withdrawn, wagered, or refunded except where required by law or expressly stated by us in writing.

No cash, prize, sweepstakes, contest, or reward promotion is offered unless separate Official Rules are posted. If chance, prizes, paid entry, or promotions are used, separate counsel-reviewed rules are required before launch.

• You may not buy, sell, trade, broker, transfer, exploit, duplicate, farm, manipulate, or create secondary markets for accounts or virtual items outside the Service.
• We may manage, modify, rebalance, expire, suspend, remove, or discontinue virtual items, Fame, keys, chests, loadouts, rewards, or related systems at any time.
• We do not guarantee continued availability, rarity, utility, value, ranking impact, prize eligibility, or compatibility of any virtual item.

Payments and refunds

Certain features may require payment. Prices, taxes, fees, billing terms, and available payment methods may change. By making a purchase, you authorize us and our payment processors to charge the payment method you provide for the amounts shown at checkout, including applicable taxes and fees.

Unless required by law or expressly stated in a written refund policy, purchases are final and non-refundable, including purchases of virtual tokens, keys, chests, loadout items, digital content, generated videos, boosts, or other digital features.

Chargebacks, payment disputes, fraud, abuse, or payment failures may result in suspension, termination, removal of virtual items, or other account action.

Subscriptions if offered

If and only if we offer subscriptions or recurring paid features, the applicable checkout flow will disclose price, billing interval, renewal terms, cancellation method, cancellation effect, and any other legally required recurring-billing terms before you are charged.

By subscribing, you authorize recurring charges until you cancel through the disclosed method. Cancellation stops future recurring charges but does not automatically provide a refund for past charges, unused time, virtual items, or digital content unless required by law or stated in the applicable subscription terms.

Acceptable use

You agree not to use the Service to:

• Violate any law, court order, or third-party right.
• Upload or generate content involving minors, child sexual exploitation, grooming, or sexualized depictions of minors.
• Create, upload, or share non-consensual intimate imagery, including synthetic or AI-generated intimate content.
• Harass, threaten, bully, abuse, defame, dox, exploit, or target another person.
• Promote hate, violence, terrorism, self-harm, illegal activity, or real-world harm.
• Impersonate another person or falsely imply endorsement, affiliation, sponsorship, authorization, criminal conduct, real statements, or real events.
• Upload another person's face, photo, likeness, voice, name, persona, or personal information without permission.
• Manipulate votes, rankings, Fame, leaderboards, rewards, token systems, chests, keys, or loadout mechanics.
• Use bots, scripts, automation, scraping, crawling, reverse engineering, probing, overloading, or unauthorized methods to access or interfere with the Service.
• Bypass paywalls, usage limits, moderation systems, safety tools, account restrictions, or technical protections.
• Upload malware, harmful code, spam, scams, phishing content, or fraudulent materials.
• Use the Service for gambling, wagering, cash redemption, financial speculation, or unauthorized prize promotions.

Moderation and reporting

We may review, monitor, remove, restrict, label, demonetize, downrank, disable, or refuse to generate or publish any content at any time, with or without notice.

We may suspend or terminate accounts, limit features, remove virtual items, adjust Fame or rankings, block payments, preserve evidence, or report activity to law enforcement when we believe it is necessary to protect users, the public, the Service, or our business.

To report safety concerns, abuse, infringement, impersonation, non-consensual content, or other violations, contact [email protected]. Do not upload, copy, send, or attach suspected child sexual abuse material in a report. Provide URLs or context only.

Copyright and DMCA

If you believe content on the Service infringes your copyright, send a notice that complies with the Digital Millennium Copyright Act to our DMCA contact: Joseph Miller, Your Epic Battle LLC, 137 Collins Rd, Kelso, Washington 98626, [email protected].

We may terminate repeat infringers where appropriate. Publishing contact information on this site does not by itself complete Copyright Office designation or guarantee DMCA safe harbor eligibility. Formal DMCA safe harbor also requires maintaining current agent registration with the U.S. Copyright Office and meeting other legal requirements.

By using the Service, you acknowledge that we may collect, use, store, disclose, and process information as described in those policies.

Intellectual property

The Service, including our software, designs, templates, visual systems, cinematic effects, AI workflows, databases, trademarks, logos, trade dress, text, graphics, interfaces, and other materials, is owned by Your Epic Battle LLC or its licensors and protected by intellectual property laws.

Except as expressly allowed by these Terms, you may not copy, modify, distribute, sell, lease, reverse engineer, create derivative works from, or exploit any part of the Service. You may not use our name, logos, branding, or trademarks without prior written permission.

Third-party services

The Service may integrate with or link to third-party services, including payment processors, hosting providers, analytics providers if later enabled, social platforms, AI infrastructure providers, and content delivery services.

We are not responsible for third-party services, websites, terms, policies, content, or practices. Your use of third-party services may be governed by their own terms and policies.

Termination

You may stop using the Service at any time. We may suspend, restrict, or terminate your access if we believe you violated these Terms, created risk or liability, abused the Service, infringed rights, failed to pay amounts owed, or otherwise harmed users, the Service, or our business.

Upon termination, your right to use the Service ends immediately. We may delete, retain, restrict, or preserve account data and User Content as permitted by law and our policies. Sections that by their nature should survive termination will survive.

Disclaimers

The Service is provided as is and as available. To the maximum extent permitted by law, Your Epic Battle LLC disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, reliability, safety, and uninterrupted operation.

We do not guarantee that the Service will be secure, error-free, available at any particular time, compatible with your device, free of harmful components, or that generated outputs will meet your expectations.

We do not guarantee Fame, rankings, rewards, virtual item availability, battle outcomes, video quality, generation speed, moderation outcomes, or public visibility.

Limitation of liability

To the maximum extent permitted by law, Your Epic Battle LLC and its owners, officers, employees, contractors, agents, affiliates, licensors, service providers, and partners will not be liable for indirect, incidental, consequential, special, exemplary, punitive, or enhanced damages, including lost profits, lost revenue, lost data, account loss, virtual item loss, reputational harm, or cost of substitute services.

To the maximum extent permitted by law, our total liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of the amount you paid to us for the Service in the six months before the event giving rise to the claim or $100.

This limitation does not limit liability that cannot legally be limited, including liability for intentional misconduct where applicable. Some jurisdictions do not allow certain limitations, so some limitations may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless Your Epic Battle LLC and its owners, officers, employees, contractors, agents, affiliates, licensors, service providers, and partners from claims, demands, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the Service, User Content, generated outputs, public sharing, violation of these Terms, violation of law or third-party rights, misuse of another person's likeness or personal information, or payment disputes, fraud, chargebacks, or unauthorized transactions.

Dispute resolution

Before filing a claim, you and Your Epic Battle LLC agree to try to resolve disputes informally by sending written notice describing the dispute and requested relief. Notices to us must be sent to Your Epic Battle LLC, 137 Collins Rd, Kelso, Washington 98626, and [email protected].

If the dispute is not resolved within 30 days after notice is received, either party may begin arbitration or, if applicable, a small claims court case.

Arbitration, class waiver, and carve-outs

You and Your Epic Battle LLC agree that disputes arising out of or relating to these Terms, the Service, accounts, purchases, virtual items, User Content, generated outputs, or communications with us will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except as stated below.

This arbitration agreement does not prevent claims that qualify for small claims court, claims seeking injunctive relief for intellectual property misuse, unauthorized access, or security abuse, DMCA notices and counter-notices, Take It Down Act or non-consensual intimate imagery reports, safety reports, government agency complaints, or requests for non-waivable public injunctive relief where applicable law prohibits waiver.

You and Your Epic Battle LLC agree to bring claims only on an individual basis and waive class, collective, representative, consolidated, private attorney general, and mass arbitration procedures to the maximum extent permitted by law. You and Your Epic Battle LLC waive jury trial rights to the maximum extent permitted by law.

Arbitration opt-out

You may opt out of the arbitration agreement by sending written notice within 30 days after you first accept these Terms. Your opt-out notice must include your name, account email, mailing address, and a clear statement that you opt out of arbitration with Your Epic Battle LLC.

Governing law and venue

These Terms are governed by Washington law, without regard to conflict-of-law rules, except that the Federal Arbitration Act governs the arbitration agreement.

For non-arbitrable court claims, and only where consumer law allows, you and Your Epic Battle LLC consent to venue in the state courts located in Cowlitz County, Washington, and the federal courts for the Western District of Washington.

Changes, assignment, and entire agreement

We may update these Terms from time to time. If changes are material, we may provide additional notice, such as by email, account notice, or in-Service notice. Continued use after updated Terms become effective means you accept the updated Terms.

You may not assign or transfer these Terms or your account without our prior written consent. We may assign or transfer these Terms, the Service, or our rights and obligations in connection with a merger, acquisition, financing, reorganization, sale of assets, or by operation of law.

If any part of these Terms is found invalid or unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver. These Terms and incorporated policies are the entire agreement between you and Your Epic Battle LLC regarding the Service.
